🏛️ Background

  • Under Utah State law, newly elected officers of a proposed city may begin certain official actions after the election results are canvassed—that is, formally reviewed and certified.
  • Following the canvass (anticipated around November 18), the officers-elect of the new city may:
    • Enter into contracts
    • Adopt ordinances
    • Secure interim (“gap”) financing prior to receiving the city’s share of property and sales tax revenues
    • Appoint the city’s first Planning Commission
  • The Incorporation Transition Team, in coordination with the twelve candidates for city office, is preparing early to ensure a smooth launch of city operations.
  • While formal appointments cannot occur until after the canvass, prospective Planning Commission members may begin preparatory work—including training, orientation, and review of draft materials—even before the November 4 election and subsequent certification.
  • This proactive approach reflects our commitment to being fully operational as soon as incorporation is finalized.

⚠️ Due to the unique nature of this pre-incorporation process, the Transition Team—working in cooperation with the twelve candidates—reserves the right to modify or adjust the application process as needed. These early measures are intended to ensure the Planning Commission is ready to serve immediately following the canvass and the officers-elect’s first official actions.

đź§­ Planning Commission Powers and Duties

Note: These powers become fully operative only after the city receives its official Certificate of Incorporation from the Utah Lieutenant Governor. The following summary reflects standard duties under Utah Code Title 10, Chapter 9a.

1. General Plan Oversight

  • Review and recommend adoption or amendments to the city’s general plan, which guides long-term land use and development.

2. Land Use Regulations

  • Recommend ordinances governing:
    • Subdivision of land
    • Zoning and land use controls
    • Amendments to existing land use regulations

3. Delegation of Authority

  • Recommend delegation of powers to:
    • A land use authority (e.g., zoning administrator or board)
    • An appeal authority to hear land use appeals

4. Application Processes

  • Recommend procedures that:
    • Streamline review of routine, uncontested matters
    • Ensure formal consideration of contested applications
    • Protect the rights of applicants and affected parties to be heard and to appeal

5. Public Hearings

  • Conduct public hearings before making recommendations on general plans or land use ordinances, per Utah Code § 10-9a-404

6. Advisory Role

  • Provide recommendations to the city council, which may:
    • Adopt, modify, or reject the commission’s proposals
    • Treat a failure to make a timely recommendation as a negative recommendation

7. Training Requirements

  • Members must complete four hours of land use training (ref)
